Membership Agreement

All rights to the https://www.iznikmavicini.com/ site (“Site”) belong to Mavi Çini Seramik ve Turizm İşl. San. Tic. Ltd. Şti. (“MAVİ ÇİNİ”). The use of the site by Users and Members is subject to the following terms and conditions.

I. Membership in and use of the Site constitutes your acceptance of the terms and conditions set forth below. MAVİ ÇİNİ reserves the right to change the services, products, ideas, and artistic works offered on the Site and its extensions, including the Terms of Use, and any data presented on the Site, such as information and pricing, without prior notice or notification, to suspend the Site's publication, to cease publication entirely, and to reorganize the Site, in whole or in part, as it deems necessary. Any changes made by MAVİ ÇİNİ to the Site's Terms of Use shall become effective upon their publication on the Site, and such changes shall be deemed accepted by the user upon entering, accessing, or using the Site in any way. Individuals or legal entities who have fully completed the Site's membership form and whose membership is deemed suitable by MAVİ ÇİNİ are considered "MEMBERS." Membership is mandatory and requires 18 years of age or older. Legal entities may only apply for membership through their legal representatives. All members and visitors who log in, visit, use, or access the Site in any way ("User") declare, accept, and undertake to abide by the MAVİ ÇİNİ Website Terms of Use. The term "User" referred to above refers to any person who, through logging in as a member or otherwise, accesses, uses, or browses the Site, or connects to the Site via any communication device (such as a mobile phone or computer), or who has engaged in or is engaged in electronic data exchange through the Site.

II. Service Content
The service that MAVİ ÇİNİ will provide through the Site is the delivery of the products offered for sale on the MAVİ ÇİNİ online shop to the customer by the cargo company within the promised time, without defects or damage, after the price is paid by the member and if the stock status of MAVİ ÇİNİ is suitable.

III. General Provisions Regarding Membership
MAVİ ÇİNİ reserves the right to cancel membership at any time without giving any reason.
All intellectual property rights related to the Site (including products, designs, colors, shapes, information, text, images, brands and all other signs, page layout, etc.) are the exclusive property of MAVİ ÇİNİ. Copying, modifying, publishing, sending online or through other media, distributing, or selling any intellectual property presented on the Site, in whole or in part, is clearly and unequivocally contrary to Law No. 5846 on Intellectual and Artistic Works (FSEK) and is subject to legal and criminal penalties.
MAVİ ÇİNİ is not responsible for any direct or indirect damages that may arise due to breach of contract, tort or other reasons.
MAVİ ÇİNİ may terminate this agreement at any time and in any manner it chooses, without notice, and may transfer it partially or completely. However, the user and/or member may not transfer this agreement.

Members acknowledge, declare, and undertake that the passwords they create are their sole property and that they will not allow third parties to use these passwords under any circumstances, and that they will be responsible for any and all damages and losses that may otherwise arise. The accuracy of the information provided by the member during the membership application is the sole responsibility of the member; MAVİ ÇİNİ has no legal liability for any damages arising from providing incorrect or inaccurate membership information.
MAVİ ÇİNİ reserves the right to take all kinds of security measures, including blocking the access to the Site and cancelling the memberships of Users who act in violation of the Site Terms of Use and the above-mentioned rules, and, if necessary, to initiate legal action against violators.

MAVİ ÇİNİ shall have no legal or criminal liability for any direct or indirect damage, loss, or damage that may be incurred by Users, Members, or other third parties for any reason whatsoever, arising from the use of the Site, the use of the data and information provided on the Site, or access to the Site, including any computer viruses or similar malware. Users hereby acknowledge, declare, and undertake that they will not make any claim or demand against MAVİ ÇİNİ under any name whatsoever for any of the damages mentioned above.

IZNIK Courts and Enforcement Offices have jurisdiction over disputes arising from these "WEBSITE TERMS OF USE AND MEMBERSHIP AGREEMENT". However, for members who are consumers, Consumer Arbitration Committees and Consumer Courts in the consumer's place of residence are also authorized in accordance with the Consumer Protection Law No. 6502.
In addition, the provisions in the contract will be evaluated within the framework of the principle of interpretation in favor of the consumer.
